SMTOWN RUN CLUB 26 Terms of Use

Effective Date: July 21, 2026

These Terms govern the SMTOWN RUN CLUB 26 website, Android mobile app, Wear OS app, and connected race services provided by the SMTOWN RUN CLUB 26 Organizing Committee. The app and its systems are operated by FXIP Co., Ltd.

1. Acceptance and Application

A user may use the service after reviewing these Terms and selecting the required acceptance item in the app. The accepted Terms version and acceptance time are recorded on the server.

Feature-specific screens, notices, race guides, and a ticket seller's purchase terms also apply to the relevant service. If they conflict, mandatory law, a separate agreement, a feature-specific notice, and these Terms apply in that order.

2. Eligibility and Accounts

The app does not newly collect date of birth to make an automatic age decision. Eligibility is checked through race registration information and race procedures.

3. Services We Provide

We provide the following features:

Features may vary by device, permission, network, participation status, and operating schedule. The current public version does not provide token-entry drawings, prizes, or ordinary-user photo-print uploads.

4. Race Participation

The latest official notice controls exact assembly and start times, course, cutoff, participant items, insurance, and on-site operations. Participants must wear their bib and timing chip correctly, remain on the designated course, and follow instructions from police, medical staff, and race staff.

Proxy participation, resale of an entry, use of another person's bib, leaving the course, record manipulation, disruption, or dangerous conduct may result in disqualification or future participation restrictions.

Ticket purchases, cancellations, changes, and refunds are governed by the applicable seller's purchase terms and applicable law, not by the app. Non-waivable consumer rights in the participant's country of residence remain unaffected.

Photos or videos may be taken at the venue for recordkeeping, news, or promotion. The scope and purpose follow the notice shown at registration or at the venue. Deletion requests may be sent to the Organizing Committee, although removing one person from a lawful group recording may not always be practicable.

5. Running, Location, and Health

The user starts and stops each run. During a run, location measurement may continue while the screen is off or another app is open so that route recording is not interrupted. The app displays an ongoing notification.

GPS, sensors, maps, and network conditions may cause errors in distance, route, pace, duration, and heart rate. We may review or cancel a mission completion or reward when abnormal movement, location manipulation, vehicle travel, or duplicate submission is suspected.

Exercise and heart-rate information is for general fitness reference only. The app is not a medical device and is not intended to diagnose, treat, or prevent a condition. Users must consider their own health and surroundings. Stop exercising and seek medical advice if pain, dizziness, or unusual symptoms occur.

6. Tokens and Rewards

Tokens are in-service points granted for mission completion and other service activities. They are not cash, electronic money, or deposits and cannot be withdrawn, sold, transferred, or redeemed for cash.

The current service has no automatic token expiration and no active token-entry drawing. Before introducing a use for tokens, we will separately disclose the token cost, period, eligibility, cancellation rules, and how results can be checked. Closing an account resets the token balance to zero.

Tokens issued because of an error, duplicate grant, manipulated record, or violation of these Terms may be corrected or revoked.

7. Photos and External Sharing

Users may select only photos they have the right to use. A user must not save or share a photo that violates another person's privacy, publicity, copyright, or other rights.

Sticker creation takes place on the device. When a user shares to Instagram or another app, that external app's terms and privacy policy apply. We do not control the external app's subsequent processing selected by the user.

8. Google Maps

The app includes Google Maps features and content. Use of Google Maps is subject to the Google Maps End User Additional Terms and the Google Privacy Policy.

Map and location functions may be limited by the availability of Google or device services.

9. Spotify

Connecting Spotify is optional and may require the Spotify app, a signed-in account, and the necessary Spotify eligibility. Spotify content may be played and controlled only for personal, non-commercial use. No right to download or copy Spotify content is granted.

The Spotify Terms of Use and Spotify Privacy Policy also apply. When a user disconnects Spotify, the app asks our server to delete the connection credential and immediately deletes temporary NFC metadata from the device. If that request fails because of a network or API error, the server credential may remain until it expires.

11. Service Changes, Maintenance, and Updates

We may change or suspend a feature for safety, legal, security, technical, race-operation, or external-service reasons. Where possible, we will give advance notice in the app or on the website. Emergency security or outage work may be announced afterward.

An app update may be required for safe operation and server compatibility. The app may be unavailable until a required update is installed. Network, Google, Spotify, device-manufacturer, or carrier outages may temporarily affect features.

12. Restrictions and Account Closure

If a violation, abuse, security risk, or harm to another user is confirmed, we may cancel affected records or rewards or restrict access as reasonably necessary. Except in an emergency, we will provide the reason and an available appeal method where practicable.

Users may close an account under My Profile → Account → Delete Account. Deleting the app account does not automatically cancel race registration. Ticket cancellation and refunds must follow the seller's procedure.

13. Intellectual Property

The app, logos, designs, text, images, software, and content supplied by us belong to the Operator or the relevant rights holder. These Terms grant only a limited, personal right to use the service.

Rights in a photo selected by a user remain with the user or original rights holder. We do not use that photo for our own promotion in the current public service.

14. Responsibility

We provide the service with reasonable care. To the extent permitted by law, responsibility may be limited for losses caused by sensor or GPS error, the user's device or network, failure to follow instructions, unforeseeable natural events, or an external-service failure outside our reasonable control.

Nothing in these Terms excludes liability for our intentional or negligent acts where liability cannot legally be excluded, or limits non-waivable consumer rights in the user's country of residence.

16. Changes, Governing Law, and Contact

We may update these Terms when the service or law changes. We will announce a material change at least seven days before it takes effect and, where practicable, an important adverse change at least 30 days in advance.

These Terms are generally governed by the laws of the Republic of Korea. Mandatory consumer-protection law and jurisdiction in the user's country of residence remain unaffected. We will first try to resolve a dispute in good faith; if unresolved, a court or dispute-resolution process available under applicable law may be used.
